The undersigned has provided or intends to provide to Bonneville International Corporation (“BIC”) and its radio station, WTMX (the “Station”), the commercial production (or elements thereof) identified as KISS THE SKY by DANIELLE BOLLINGER (the “Commercial Production”), for airing on the Station’s streaming audio component. The undersigned hereby grants to BIC and the Station the right to publish and air the Commercial Production via the Station’s streaming audio component.

The undersigned agrees to defend, indemnify, and hold harmless BIC and the Station against any loss, damages, expense, or cost, including but not limited to attorneys’ fees and costs, arising from or relating to any breach of the foregoing warranties or from the airing of the Commercial Production on the Station’s streaming audio component.

The undersigned hereby represents:
- That it owns all right, title, and interest in and to, or otherwise has the right to use for the purposes anticipated by this release form, all elements of the Commercial Production, including, without limitation, any and all voiceover talent, script, music beds, sound effects, jingles, and any other elements that may be used in the Commercial Production;
- That it has obtained and provided to the Station all necessary releases, permission, and/or licenses from any third parties for the use in the Commercial Production of such parties’ voices or other materials in which they may have a copyright, right of privacy, or other right or interest;
- That it has the exclusive right to grant the rights referred to herein; and
- That the Commercial Production is free from libelous, infringing, or other unlawful matter.
The undersigned agrees to defend, indemnify, and hold harmless BIC and the Station against any loss, damages, expense, or cost, including but not limited to attorneys’ fees and costs, arising from or relating to any breach of the foregoing warranties or from the airing of the Commercial Production on the Station’s streaming audio component.
